The law firm formerly representing suspended driver Jeremy Mayfield in his lawsuit against NASCAR has filed a lawsuit against Mayfield for $371,973 in legal fees.

The Charlotte firm of James, McElroy and Diehl filed the lawsuit Wednesday afternoon in North Carolina Superior Court. The firm was replaced by nationally known Mark Geragos in October.

According to the complaint, Mayfield and the firm had an oral agreement for the firm to represent Mayfield, who then failed to make the promised monthly payments in full. When payments were made, they were less than the promised amount, according to the complaint.

This is the fourth lawsuit that Mayfield faces over unpaid bills. Mayfield and his Mayfield Motorsports Inc. have been sued by chassis and body shop Triad Racing Technologies, racing safety equipment company Impact Racing and engine builder Arrington Manufacturing.

Mayfield had an auction last week on his property, the proceeds of which could be used to pay off some of his debts.

Mayfield was suspended by NASCAR for a May 1 drug test that NASCAR says was positive for methamphetamines. Mayfield contends that the finding was the result of his taking the prescription drug Adderall and over-the-counter Claritin-D. He also questions the procedures NASCAR used in determining the results.
