Jason Myers, who last year was car chief for the No. 99 Roush Fenway Racing NASCAR Sprint Cup Ford Fusion driven by Carl Edwards, has sued the team for allegedly firing him after he attempted suicide for a third time in February.

In a suit filed in Cabarrus County (N.C.) Superior Court, Myers claimed that Roush Fenway Racing violated the Family Medical Leave Act when it terminated him in February.

Myers claimed that he suffered from depression and on three separate occasions attempted suicide. Two of the those attempts came in 2008, when Myers worked as the car chief for Edwards, and the third came in February, shortly after being demoted to the position of mechanic.

Myers filed a formal complaint with the Equal Employment Opportunity Commission June 1, one day before filing the suit.

Roush Fenway Racing President Geoff Smith told the Associated Press that the suit was filed because of the prevailing economic conditions.

“These meritless claims would not be made at all in times of full employment in our industry, but in tough economic times, lottery tickets and lawsuits
become more attractive,” Smith told AP. “This is one of those times.”
